Mayfield told NASCAR.COM through his wife, Shana, that he could not talk about the situation at this time because of legal reasons.

Mayfield is seeking a legal remedy to the termination of his contract, sources told Sporting News' NASCAR News Service on Friday.

According to the NASCAR News Service story, information obtained from sources in the Iredell County Clerk of Court's office in Statesville, N.C., indicated Mayfield had obtained a temporary restraining order, the contents of which were not immediately known, and was seeking a preliminary injunction against his ouster in a hearing in Statesville on Friday.

"We just need a guy -- or a girl -- who can run that car in 20th or 25th position," said Evernham, who noted that Truck Series driver Erin Crocker was not an option because she needed more experience. "That car is good enough to run in the top 35 in points.

"I need a 25-year-old Bill Elliott."

If he even thinks about putting Erin in a cup car...I will seriously doubt his sanity.

Edit: That's the first thing I thought when I watched NASCAR Live and Bob was talking.

This move doesn't surprise me at all..

he already said she is not an option.

it is a shame that everything is going to get ugly. This is a no-win situation for everybody.

Hopefully things can get worked out without a big legal mess.

I know, but Bob didn't confirm that during NASCAR Live. At least not when I was watching. But to tell you the truth, with things going the way they are, I wouldn't be surprised if she was considered.

I don't think it's possible to be surprised anymore. Silly Season just gets worse as each season passes.

Especially poor Kasey, who should be the Evernham big news coming out of today with such a good qualifying run -but he won't be. :(

I really am shocked by this, but I guess I shouldn't be.
UPDATE:

Team owner Ray Evernham then said Friday morning that Mayfield had been “terminated” and would not return to the car. Lawyers for the team and for Mayfield then spent much of the day Friday in an Iredell County courtroom wrangling over the driver’s attempt to block his firing.

Attorneys apparently reached a settlement on those issues late Friday afternoon.
I hope so!

I said to my husband earlier that I wouldn't be surprised to see Erin in the car.

I just hope for Kasey's sake that Ray gets his head together and doesn't do what he did to Jeremy, to him---upend his team for "the next big thing" to come along (Erin).

I think I'd puke.

Did anyone else find it odd that Jeremy had obtained a restraining order? I understand trying to keep his ride for the rest of the season through legal means, but why the restraining order?

I just hate all of this had to get so ugly, mostly for Kasey and Scott's sake. :(

Well, it's time to focus on the #9 and #10 cars right now. That is the face of EMS now and those are the cars I'm going to continue to throw my support to. Jeremy is as good as the Nova to me. I can't belive I was a fan of his ever. :no

Did we ever find out what the restraining order was for? Just curious because I didn't think it got that bad between the two guys...

I don't know for sure. :) But I wonder if it has to do with this:
QUOTE
At his lawyer's request, Mayfield showed up in Watkins Glen so he could say that he held up his end of the contract, he was there Friday morning to go to work. The matter was settled out of court late Friday.
My guess is Jeremy's lawyer got the restraining order just to make sure that Ray and Jeremy didn't have any contact on Friday when they were both there at the racetrack. It was probably just a precaution because tempers were high, because can you imagine how mad Ray would have been if the court had ruled in Jeremy's favor? Doesn't Ray know how to box really good, too? B)

Still sad, though. That's one thing about NASCAR: in other sports, you can avoid old teammates and owners except for games a couple of times a year. In NASCAR you have to see everybody AND live with them in the same motorcoach lot four days a week every week, whether you like them or not.
